Privacy Policy for EU Residents

Effective Date: July 3, 2025

Welcome to Octopot. This Privacy Policy explains how we collect, use, share, and protect your personal data when you interact with our services, in compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR), the UK GDPR, and the Swiss Federal Act on Data Protection (FADP).

This policy applies to individuals located in the European Economic Area (EEA), the United Kingdom, and Switzerland who access or use Octopot's services. Please read this document carefully to understand how we handle your personal data.

1. Who We Are

Octopot is operated by Baytech BV, a Netherlands-based technology company focused on AI-powered HR solutions. For GDPR purposes, Baytech BV acts in two roles. When companies use Octopot to recruit, the company you apply to (or that adds you to its talent pool) is the Data Controller of your candidate data, and Baytech BV processes that data on its behalf as a Data Processor (GDPR Art. 28). When you use Octopot's candidate tools with your own account (CV creation and optimisation, cover letters, interview preparation), and for the accounts of our business clients' users, our website and our sales communications, Baytech BV is the Data Controller. You can reach us at:

9. How to Exercise Your Rights

You can make any privacy-related request by contacting us at privacy@octopot.co. We will respond to valid requests within 30 days. In some cases, we may need to verify your identity before acting on your request.

10. Data Security

We implement a range of security measures including encryption in transit, role- and department-based access control, audit logging, and secure development practices. However, no system is completely immune to risk, so we recommend using strong passwords and avoiding sharing account credentials.

11. Children’s Privacy

Our services are not intended for individuals under the age of 16. We do not knowingly collect data from children. If you are a parent or guardian and believe your child has submitted personal data, contact us immediately and we will take appropriate steps to delete the data.

12. Automated Decision Making

Octopot uses AI to help candidates (CV, cover letter and interview suggestions that you review and can edit) and to support hiring companies: CV and job-fit scoring, screening against the company's rules, and evaluation of interview answers, transcripts and facial expressions in video interviews. Hiring decisions are made by the hiring company, not by Octopot's AI. You have the right to request human intervention and to contest decisions.

13. Changes to This Policy

We may update this Privacy Policy as needed to reflect changes in legal requirements or our services. When we do, we will post the updated version here and revise the “Effective Date” accordingly. If changes are significant, we will notify you via email or a prominent notice on our platform.
